Effective October of 2006, Connecticut law changed regarding a custodial parent's ability to relocate following a divorce and child custody arrangement. At the Law Office of Jill H. Changes in Connecticut Law

Previously, the law was not clear regarding what type of finding the court needed to make to allow relocation. The burden of proof also lied with the non-relocating parent.

The new statute now requires the relocating parent to prove, by a preponderance of the evidence, that the relocation is for a legitimate purpose, the proposed location is reasonable in light of that purpose, and that the move is in the best interests of the child. In determining whether the relocation is appropriate, the court will consider:

  • Each parent's reason for seeking or opposing the relocation
  • The quality of the relationship between the child and each parent
  • What kind of contact the non-relocating parent will be able to maintain with the children
  • The impact the relocation will have on the non-relocating parent and child

The court also looks at whether or not the relocation will enhance the child's life educationally, economically, and emotionally. They will also consider whether or not it is feasible to preserve the non-relocating parent's relationship with the child through visitation arrangements.

Because these are complex cases and the court must carefully evaluate the circumstances of each relocation case, this is typically a lengthy process.
